A RESOLUTION PROVIDING FOR A MUNICIPAL ANNEXATION PLAN
FOR TILE CITY OF SEYMOUR, BAYLOR COUNTY, TEXAS


WHEREAS, Chapter 43 of the Local Government Code of the
State of Texas provides that each municipality shall adopt a municipal annexation plan.

IT IS THEREFORE RESOLVED BY TILE CITY COUNCIL OF THE CITY OF SEYMOUR AS FOLLOWS:

1.
That annexation by the City of Seymour shall be in accordance with the
provisions of this plan as adopted or as it may be hereafter amended.

2.
Annexation by the City of Seymour shall be limited to property meeting the following criteria:

A. The property must be in extraterritorial jurisdiction of the City of Seymour,
SAVE AND EXCEPT for property owned by the City of Seymour; and

B. Any property annexed by the City of Seymour shall contain fewer than
100 separate tracts of land, on which one or more residential dwellings are located on each tract; or

C. The City of Seymour may annex property when petitioned to do so by more than 50% of the real property owners
in the area proposed for annexation, or by vote or petition of the qualified voters or real property owners,
as provided in Subchapter B of Chapter 43 of the Local Government Code of the State of Texas; or

D. The property is the subject of an industrial district contract under Section 42,044, or
a strategic partnership agreement under Section 43.0751 of the Local Government Code of the State of Texas; or

E. The City may annex property when the City Council determines that annexation is necessary to protect
the area proposed for annexation, or to protect the municipality from imminent destruction of property or
injury to persons, or a condition that constitutes a public or private nuisance, as defined by
background principles of nuisance and property laws of the State of Texas.

3.
If at any time the City of Seymour has an Internet website, the City Secretary of the City of Seymour is herebyinstructed to post and maintain the posting of this annexation plan on said Internet website; post and maintain the posting on said Internet website of any amendments to include an area in its annexation plan until the date the area is annexed; and post and maintain the posting on the Internet website of any amendments to remove an area from the annexation plan until the date the municipality may again include the area in its annexation plan.
