REGULAR MEETING ENDS – PUBLIC HEARING BEGINS AT 7:16 p.m.
 
A public hearing held to receive information from citizens regarding the adoption and implementation of a zoning ordinance for the City of Seymour, Texas.
 Mayor Craighead asked if any one would like to address the council.

 Ms. Carol Bomberger addressed the council and asked if the public hearing
would be on volume 4 and what happened to two and three.

CA Shephard explained it was divided to make it easier, but, it is one big volume
broken into four chapters. Joe explained the different chapters are drainage, infrastructure improvements, zoning and subdivisions.

Ms. Bomberger stated her name and said she assumed that the adoption proposed is being accepted in its entirety. In other words, the council is not making any changes, corrections, or adaptations to this comprehensive development plan.

Mayor Craighead replied by stating that the city had adopted the comprehensive plan Volume 1 at a meeting sometime back, with no plans at this moment to make any changes to the plan.
Ms. Bomberger stated that was her only question. She stated as a general overall comment on this that it seemed to her it was a general plan sort of a “one size fits all”, for cities of any size and there were some things in it as in the subdivision that were minor, but, really didn’t seem to have application for a town the size of Seymour and was just wanting to point these things out.
Ms. Bomberger asked if there would be another chance for her to make sure there were not unintended consequences of adopting this plan because it is a one size fits all and she didn’t get the impression that it is specifically for Seymour, even though it really was. She asked if that was clear as mud.

Mayor Craighead stated that even though it may be a one size fits all type of a plan there would be a reason or need to have items such as the subdivision or items it listed in the plan. Who knows what might happen in the future, someone might decide to build a subdivision and there would need to be some type of an ordinance or a zoning ordinance for that subdivision, otherwise, it would be exempt from the ordinance.

Ms. Bomberger stated that she knew the council would not close down businesses, but, it does appear to me that there appear issues that would have to be grandfathered if you read this closely. I will not waste the councils time until I dig those things back up, because, I haven’t had a chance to look them over again. I do want to go on record as saying I think there are a few things I feel we need to address at the next zoning meeting.

Mayor Craighead suggested to Ms. Bomberger to go by and visit
with Joe at his office if she has any concerns.

3. Discuss and consider information received from citizens
regarding the adoption and implementation of a zoning ordinance
for the City of Seymour, Texas.


Mayor Craighead asked if the council had any questions/comments concerning the Public Hearing regarding the adoption and implementation of a zoning ordinance for the City of Seymour, Texas.

Council Member Fest stated that she was asked a question by a citizen , but, did not know the answer and commented that she understood if a business was in business now, it would be grandfathered and it wouldn’t be closed, but, what if they sold it to someone else would that be considered closing it ? If it stayed open and they just sold it to someone else as long as the other person continued the business right along, would that be grandfathered also?

CA Shephard answered yes to the question, along with Mayor Craighead commenting that it stipulates in the plan that if the business closes for a certain period of time (6 months), and sells it and someone else opens it, they would have to have a special permit or get a special permit to re-open it in a residential location. It would go through procedures such as getting approval from neighbors and that type of thing.

CM Fest asked if they sold the business, but, kept it in operation it would be ok. Mayor Craighead answered yes, as long as it continued in business, it could change ownership.
This item did not call for any action to be taken. 

4. Discuss, consider and give direction to staff concerning repairs to city buildings from storm damage to include authorizing soliciting for bids.

Mayor Craighead asked CA Shephard to address this item:

CA Shephard stated three of the buildings the city owns which are the Police Station, Fire Hall and City Pool were leaking to the point that they needed immediate repair. We got those fixed. Booe Roofing repaired the Police Station, Warren’s repaired the City Pool and Tim’s Roofing repaired the Fire Hall. The other two buildings in need of repairs, is the City Hall and Seymour Industrial Building up on the hill. These buildings will exceed the $25,000 limit. I am asking Council to authorize city staff to go out for formal bids. We have some unsolicited bids and those costs will probably exceed the $25,000 limit. The other smaller buildings that were damaged and are under the $25,000 repair cost I would also ask council to authorize city staff to do what we need to do to get them repaired. If we run into something we don’t foresee I will be in conference with the Mayor about it.

Motion:

A motion was made by Council Member Butler, seconded by MPT Tankersley, to authorize CA Shephard to go out for bids on the two buildings being City Hall and Seymour Industrial and also repair the smaller buildings as needed.

Vote on Motion:

passed unanimously.
