A regular City Council Meeting was held at 7:00 p.m. Thursday, May 15, 2008
at the Portwood Arts and Civic Center, 800 E. Morris, Seymour, TX 76380.

CALL TO ORDER/ ROLL CALL
by Mayor Craighead at 7:00 p.m.

Council Present:
Mayor Dan Craighead, Council Member Donald Coltharp, MPT Rose Tankersley,
Council Member Elect Nan Gilbert-Mathis, Council Member Elect Billy Henricks
and Council Member Sid Winn.

Council Absent:

none

Counsel Present:

none

Staff Present:
City Administrator Joe Shephard, City Secretary Conchita Torrez,
Economic Development Department Director John Studer,
Police Chief Tommy Duncan, Water/Wastewater Superintendent Greg Shumate,
Reverse Osmosis Superintendent Rick Garcia, Code Compliance Officer John Byrket
and Street Superintendent Adam Sturgeon.

Participants/Guests:

John Stallings, Matt Gwinn with Banner Publishing, Kathy Harper;
Election Judge, Alma Hicks, Flossie Smith and David Frey.

Pledge Of Allegiance:

1. Canvass of Election Returns from the May 10th, 2008,
General/Special Election for Municipal Officers for a two-year term for Council Member Place #1, Council Member#3, Council Member #5 and Special Election for Council Place#4, as presented by
Election Judge Kathy Harper.


Kathy Harper, Election Judge for the May 10th, 2008,
read the results for each candidate as follows:

Council Place # 1,
Donald Coltharp received 157 votes, Flossie Smith – 102 votes,
with Council Member Coltharp being elected for two – Year Term.

Council Place # 3,

Michael Kimbler received 74 votes, Nan Gilbert Mathis received 170 votes
and Write-In Candidate Alma Hicks received 13 votes with
Council Member Gilbert-Mathis being elected for a Two-Year term.

Council Place #5,
Council Member Sid Winn ran unopposed and received 215 votes for a Two -Year Term.

Council Place #4, Special Election,

Council Member Elect Billy Henricks ran unopposed and received 196 votes
for a One-Year unexpired term.

Motion:
Motion made by MPT Tankersley to accept the Canvass Election Results for the
2008 City General and Special Election, as presented by Election Judge, Kathy Harper
and seconded by Council Member Winn.

Vote on Motion:
passed unanimously.

2. Consider approving Resolution No. 1293,
Declaring the Results of 2008, City Officer General and Special Election.


Motion:
Motion made by MPT Tankersley and seconded by Council Member Coltharp,
to approve Resolution No. 1293, declaring the results of the Election.

Vote on Motion:

passed unanimously.

RESOLUTION NO. 1293

A RESOLUTION CANVASSING THE RETURNS AND DECLARING THE
RESULTS OF THE MAY 10, 2008 ELECTIONS FOR CITY OFFICERS.


On this the 15th day of May , 2008, the City Council of the City of
Seymour, Texas, convened in Regular Session open to the public at the regular meeting place, 800 E. Morris Street, Portwood Art & Civic Center.

Council Member Donald Coltharp introduced a resolution and order and moved its adoption. The motion was seconded by Council Member MPT Rose Tankersley, and the motion carried with it the adoption of the resolution and order prevailed by the following vote:

There came to be considered the returns of a General and a Special Election held on the 10th day of May, 2008, for the purpose of electing the hereinafter named officials, and that each of the candidates in said election received the following votes:

FOR COUNCIL MEMBER, Place 4 – One Year Unexpired term

THEREFORE, BE IT RESOLVED AND ORDERED BY THE CITY COUNCIL OF THE
CITY OF SEYMOUR, TEXAS:


That said election was duly called; that the notice of said election was given in accordance with law, and that said election was held in accordance with law, and that DONALD COLTHARP, was duly elected to Alderman, Place 1, NAN GILBERT-MATHIS was duly elected to Alderman, Place 3, SID WINN was duly elected Alderman, Place 5, each in the general election for a two-year term and BILLY HENRICKS was duly elected Alderman, Place 4, for a one year unexpired term. Said above named parties are hereby declared duly elected to said respective offices, subject to the taking of their oath of office as provided by the laws of the State of Texas.

It is further found and determined that in accordance with the order of this governing body the Secretary posted written notice of the date, place and subject of this meeting on the bulletin board located in the City Hall, a place convenient and readily accessible to the general public, and said notice having been posted and remaining posted continuously for at least 72 hours preceding the scheduled time of said meeting. A copy of the return of said posting shall be attached to the minutes of this meeting shall be made a part thereof for all intents and purposes.

PASSED AND APPROVED this 15th day of May , 2008.

3. Statement of Elected Officer signed and filed with the City Secretary, from Council Member, Place #1 Donald Coltharp,
Council Place #3 Nan Gilbert-Mathis,
City Council Place #5 Sid Winn, and
Special Election Council Place #4 Billy Henricks.


Each Council Member signed the “Statement of Elected Officer” and the
statements have been filed in the City Secretary Office.

4. Oath of Office administered to City Council Member Place #1; Donald Coltharp, City Council Member Place #3; Nan Gilbert- Mathis, City Council Member Place#4; Billy Henricks and City Council Member Place #5; Sid Winn by Mayor Craighead.

Mayor Craighead swore each Council Member in to take their respective places on the Council.

No motion or vote was needed.

5. Certificates of Election issued to City Council Member Place#1; Donald Coltharp, to City Council Member Place#3; Nan Gilbert –Mathis, City Council Member Place #4; Billy Henricks and City Council Member Place#5 Sid Winn by Mayor Craighead.

Each Council Member received a Certificate of Election from Mayor Craighead.

No motion or vote was needed.
