Regular Meeting Ends and Public Hearing Begins at 7:10 p.m.

2. Conduct a Public Hearing to consider and amend
Ordinance No. 2005-01, Transfer Station Section, establishing
new fees and rates.

Mayor Reeves, Council Members and Street Supervisor Adam Sturgeon revisited the Transfer Station Ordinance, therefore, a Public Hearing was held. Council chose to make some amendments to the Ordinance and meeting closed at 7:26 p.m.

No one spoke for or against the Ordinance at this time.

Public Hearing Ends and Regular Meeting Resumes at 7:26 p.m.

Remove from table: Agenda items #3 and #4 from Septembers Meeting

3. Discuss, and take action regarding update on the
Water/Wastewater project located on the Archer City Highway as presented by Supervisor Greg Shumate.

After discussing several options with Mayor and Council regarding this issue, it was decided by Council to allow Water Supervisor to pursue project and for City Administrator John Studer to visit with City Attorney Daryl Halencak and draw up a contract to be signed by both City of Seymour and Donette Pierce.

Option 1. Speak with Ms. Pierce and agree to annex into the City Limits at a later date,
and pay for materials which total an amount of $2,735.66.
OR
Option 2. For Ms. Pierce to agree that in the event she would not annex into the
City Limits, she would pay the total price of the sewer project of $4,678.58, plus,
any incurring prices and legal fees.

Motion:
Motion made by MPT Winn, seconded by Council Member Horton to allow Greg Shumate to proceed with the Sewer Project and for City Attorney Halencak to draw up a contract for both parties.

Vote on motion passed unanimously.

 4. Discuss and take action on Ordinance regarding
Transfer Station Fees, with possible Amendment(s) to Original Ordinance 2005-01and replacing it with Ordinance 2010-08.

After revisiting Ordinance regarding Transfer Station Fees, and Council making
amendments and changes to the Ordinance presented, a motion was entertained
by Mayor Reeves.

Motion:
Motion made by Council Member Coltharp, seconded by Council Member Gilbert-Mathis to pass Ordinance No. 2010-08, with amendments as approved by Council.

Vote on Motion:
For Ordinance #2010-08- Four Against Ordinance #2010-08- One For

Vote on motion passed by majority of vote.

Recess:
Mayor Reeves called for a recess at 8:20 p.m; Meeting resumed at 8:25 p.m.

5. Discuss and consider information received from
Danny Casillas regarding City of Seymour Park Pool.

Danny Casillas gave a presentation regarding the Seymour Park Pool.
The pool is in major need of repairs, therefore, Mr. Casillas presented the Mayor
and Council with several options.

No action was taken at this time.

6. Discuss, consider and take action regarding information
received from AEP Representative Lanny Aldridge, a proposal of a
one-time payment of $100,000.00 to take care of Pass through Charge becoming effective December 1, 2010, with an amendment to
 the Master Power Purchase Agreement or receive it in a one time credit of $100,000.00, upon Buyers next monthly invoice.

After reviewing the information presented to them, Mayor intertained a motion.

Motion:
Motion made by Council Member Coltharp to accept a one time payment of $100,000.00 as proposed by AEP.

This Council Item died for lack of second.

7. Discuss, consider and take action regarding property located at
302 N. Foley, Lot 5, Block 43, Original Addition in the amount of $300.00 from Gary and Jenny Blankenship.

Motion:
Motion made by Council Member Gilbert-Mathis, seconded by MPT Winn, to accept
bid amount of $300, from Gary and Jenny Blankenship on property located at 302 N. Foley.

Vote on motion passed unanimously.
